Terms of Service

The agreement between you and Poolsignals when you use our platform and website.

These Terms of Service (“Terms”) govern your access to and use of the Poolsignals platform, SDKs and website (the “Service”). By creating an account or using the Service, you agree to these Terms. If you are using the Service for an organization, you agree on its behalf.

The Service

Poolsignals provides a realtime platform — messaging, presence, channels, stories, live streaming and video/voice calls — delivered as SDKs for web and mobile, and optionally deployable on infrastructure you control. We may update, improve or change features over time.

Accounts & API keys

  • You are responsible for the activity under your account and for keeping your credentials secure.
  • Keep secret keys secret. Publishable keys are for client use; secret keys must stay server-side.
  • Tell us promptly if you suspect any unauthorized use of your account or keys.

Acceptable use

You agree not to use the Service to:

  • Break the law, infringe others’ rights, or send unlawful, abusive or deceptive content.
  • Send messages without the consent required by applicable law and by third-party channels (for example, Meta’s WhatsApp Business policies).
  • Distribute malware, attempt to breach security, or probe, scan or overload the Service.
  • Reverse engineer or resell the Service except as expressly permitted.

Your data & tenancy

You own your data and your end users’ content. You grant us the rights needed to process it solely to provide the Service. Each app is an isolated tenant. You are responsible for your end users, for the lawful basis to process their data, and for obtaining any consents required — including for messaging and recording. Our Privacy Policy and, where applicable, a Data Processing Agreement describe how we handle personal data.

Third-party services

Some features connect to third parties under a bring-your-own-credentials model (for example, the WhatsApp Business API via your own Meta account). You are responsible for complying with those providers’ terms and for the credentials you supply.

Fees

Paid plans are billed as described at sign-up or in your order. Usage-based charges accrue with the messages, streams and call minutes you use. Fees are exclusive of taxes. We may change pricing with reasonable notice for future billing periods.

Availability

We work hard to keep the Service reliable, but except where a written service-level agreement applies, the Service is provided without a guarantee of uninterrupted availability. Enterprise plans may include a separate SLA.

Intellectual property

Poolsignals and its SDKs, software, and brand are owned by us and our licensors. We grant you a limited, non-exclusive, non-transferable right to use them to build and operate your application while these Terms are in effect. If you send us feedback, we may use it without restriction.

Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, to the fullest extent permitted by law.

Limitation of liability

To the maximum extent permitted by law, neither party is liable for indirect, incidental or consequential damages, and our total liability arising out of the Service is limited to the amounts you paid us for the Service in the twelve months before the claim.

Indemnification

You will defend and indemnify Poolsignals against claims arising from your use of the Service, your content, or your violation of these Terms or applicable law.

Termination

You may stop using the Service at any time. We may suspend or terminate access if you materially breach these Terms or use the Service in a way that risks harm to others. On termination, your right to use the Service ends; provisions that by their nature should survive will survive.

Changes to these Terms

We may update these Terms from time to time. For material changes we’ll provide notice, and continued use after changes take effect means you accept them.

Governing law

These Terms are governed by the laws applicable at Poolsignals’ principal place of business, without regard to conflict-of-laws rules. The specific governing law and venue are set out in your order or enterprise agreement where applicable.
